This is the last will and testament of one Thomas Cobley of Spreyton in the County of Devon, Yeoman. I give and bequeath unto Mary Cobley the daughter of my nephew Thomas Cobley of Puddicombe Park in Spreyton aforesaid the sum of two hundred pounds. Also I give and bequeath unto Richard Cobley son of the aforementioned nephew Thomas Cobley the sum of fifty pounds.
Also I give and bequeath unto William Cobley, Elizabeth Cobley, Ann Cobley, Joan Cobley and Jane Cobley, sons and daughters of my nephew Thomas Cobley the sum of twenty pounds each . Also I give and bequeath unto John Veazey son of my cousin Margarett Veasey the sum of twenty pounds - also I give and bequeath unto Ann Salter and Margarett Bazely (?) , sisters of my kinsman Thomas Cobley of Bubear in Spreyton aforesaid the sum of twenty pounds each.
Also I give and bequeath unto my kinsman Thomas Cobley of Bubear aforesaid the sum of one guinea and also I give and bequeath him Thomas Cobley all debts, sum and sums of money as he shall owe or stand indebted to me in at the time of my death on any account whatsoever.
Also I give and bequeath unto Mary Sticks, wife of Henry Sticks of Colebrooke in the county of Devon the sum of one guinea, all which legacies except as hereinafter is mentioned, I will shall be paid severally at the end of one year after my decease without any interest. But if not paid the expiration of such one year then I will that the same sum shall carry interest at the rate of five pounds per centum per annum. But it is my will and meaning that the legacies hereby by me given to my kinsmen and kinswomen as are under the age of twenty one years shall not be payable or be paid until they severally attain their several ages of 21 years. And that in case either of them shall happen to die under the said age of 21 years then the legacy of him or her or them so dieing shall not be raised or paid but shall devolve to my executor hereinafter named.
Also I give and bequeath unto my nephew Thomas Cobley, son of my brother John Cobley two shillings a week for so long as he shall live to be paid him by my executor herein after mentioned.
Also I give devise and bequeath unto John Cobley, the son of the last mentioned nephew Thomas Cobley all that my messuage and tenement and premises called Puddicombe Park with all the ------ thereto ----in which I purchased of Bartholemew Haywood situate in the parish of Spreyton to hold to him the. John Cobley his heirs and assigns
called Puddicombe Park -----------which I purchased of Bartholomew Haywood situate in the parish of Spreyton to hold to him the John Cobley his heirs and assigns forever. And I likewise give and bequeath him the John Cobley all my goods, stock and chattels which shall be on the said premises called Puddicombe Park at the time of my death.
Also I give devise and bequeath unto Richard Cobley, another son of my nephew Thomas Cobley all those my houses and tenements situate in the town or village of Spreyton ----- to hold to him the Richard Cobley, his heirs ------- and assigns forever or during my interest
Also I give devise and bequeath unto Thomas Cobley, another son of my p nephew Thomas Cobley his heirs freehold estates called Bubear and Park and all other my----- ----- and assigns all and singular my messuages lands tenements and hereditaments whatsoever or wheresoever not hereinbefore disposed of situate in the parish of Spreyton or elsewhere in the County of Devon with all the rights members privileges appendages and ----- thereunto respectively belonging or in any ---- appertaining and all my estate right title and interest therein and thereto respectively.
To hold the same and every part and parcel thereof unto and to this only and absolute use and ----- of the. Thomas Cobley his heirs and assigns forever.
And all the rest residue and remainder of my personal and testamentary estate whatsoever and wheresoever not herein before disposed of after the payment of my debts, legacies and funeral expenses. I give and bequeath the same unto the said Thomas Cobley son of the Thomas Cobley. And I do hereby constitute -------- and appoint the said Thomas Cobley the son of the Thomas Cobley whole and sole executor of this my will - hereby revoking all and every former or other wills by me at any time hereto made and declaring this to be my last will and testament. Provided ------ and I do hereby will and by me at any time hereto fore made. - ------- will and testament. Provided and I do hereby will and declare notwithstanding anything hereinbefore contained that it is my mind and intention that in further said assistance of my -------- personal estate that Thomas Cobley son of the ? Thomas Cobley his heirs ----------- do and shall with all ------ funds after my death either by mortgage or sale all or any sufficient part of the -------estates herein given devised and bequeathed him by this my will, raise and levy such sum and sums of money as shall and may be ------- for and accordingly to pay and discharge therewith all my debts and my legacies and I do charge all my ---- with the payments of all such debts of what nature or kind soever as I shall owe at the time of my death and my legacies and which my residuary persons shall fall short in the charge of as witnessed.
